Asbestos Survey Findings Lead to Six-Figure Settlement

A six-figure settlement has been paid after an asbestos survey identified extensive contamination and deterioration of asbestos-containing materials at Poole Hospital.  The claim arose after a retired employee died of mesothelioma, an asbestos-related cancer.

The claim centred on exposure to asbestos within hospital buildings where the survey confirmed that multiple areas presented a high risk. The payment was agreed by University Hospitals Dorset NHS Foundation Trust in June 2025 after legal action, although liability was not formally admitted.

The survey findings

Key findings included:

  • In B Block’s boiler room, visible asbestos debris and dust were present on pipework, ducting and ventilation systems.
  • Insulation materials in this area were unsealed and described as being in a “high damage” condition.
  • Surveyors recommended a full environmental clean of the boiler room due to contamination levels.
  • Unsealed sprayed insulation believed to be crocidolite asbestos was identified in the same location.
  • At least 18 separate samples classified as high-risk asbestos were recorded in the boiler room alone.
  • These samples were found on floors, walls, pipework, ventilation systems, air grilles and entrance areas.
  • In B Block’s plant room, at least 13 further high-risk asbestos samples were identified on walls, pipework and extractor systems.
  • In the basement service tunnel, at least three additional high-risk samples were discovered in ducting and surrounding areas.
  • Several locations were assessed as requiring immediate action, including restricted or prohibited access until remedial work was completed.
  • Other areas were designated for urgent short-term action and controlled entry due to asbestos debris and dust.

Identifying asbestos-containing materials is only the first step; organisations must also ensure that recommended actions are implemented without delay. Where surveys highlight damaged or high-risk asbestos, appropriate remediation, restricted access and ongoing monitoring are essential to reduce exposure risks and limit potential liability. Failure to respond effectively to survey results can lead not only to significant health risks but also to substantial financial and reputational consequences.
